Supreme Court blocks Louisiana abortion clinic law

The Supreme Court is stopping Louisiana from enforcing new regulations on abortion clinics in a test of the conservative court’s views on abortion rights.

The justices say by a 5-4 vote that they will not allow the state to put into effect a law that requires abortion providers to have admitting privileges at nearby hospitals.

Chief Justice John Roberts joined the court’s four liberals in putting a hold on the law, pending a full review of the case.

The four more conservative justices, including Neil Gorsuch and Brett Kavanaugh, would have allowed it to take effect. Kavanaugh wrote a dissent explaining his vote.

The law is very similar to a Texas measure the justices struck down three years ago. Roberts dissented in that case.

I think your analysis is right but the argument is that under the law only one abortion clinic would remain open because as of today only one doctor has admitting rights.

In Kavanaugh's dissent he acknowledges that if that's really the case it would create an undue burden, but he thought the law should be allowed to go into effect.

He argues that if the other doctors can't get admitting rights then the challengers could return to court - and presumably prevail.

Funny if someone hired an expert to analyze word selection and phrasing as to uncover plagiarism. They’d be suspicious of RBG suddenly saying in notes:

Hey,dudes, like it’s way better to like kick out the guys who blast our planet so like, I’m totally fed up with this like bogus crud from the old white guys’ oil lobby”

Expert looks up from his work and says: “Could you please get me fingerprints from Ocasio Cortez, please?”

After President Trump replaces RBG, he needs to ask Roberts for his resignation from SCOTUS. He’s been pivotal in several really bad decisions, including this one and Obamacare.

I don’t disagree about Roberts being a bad choice. He has become a new Anthony Kennedy, he is not yet as bad as David Souter used to be.

I disagree with Jeff Chandler about Harriet Miers being a better choice than John Roberts. That infamous speech of hers showed she was a progressive in spite of her supposed conversion. I also corrected a factual error: It wasn’t John Roberts who was nominated after Harriet Miers’ nomination was withdrawn.

If Harriet Miers’ nomination hadn’t been withdrawn, it would have been a total disaster: The Supreme Court with John Roberts and Harriet Miers, and without Samuel Alito, who is a good justice despite being weak on the Fourth Amendment.

I admit I posted the bit about Harriet Miers knowing full well — and without researching — that Roberts might not have been her replacement.

My greater point was that Roberts stinks, and I counted on our magnificent Freeper crew to shore up any factual deficiencies.

Young (pre )Justice Roberts with possible reason why he caters to the left. He’s being blackmailed for something, Perhaps it’s butt buddies. Some say the Roberts, adopted there kids from Ireland, illegally. Whatever it is, he’s not the Chief Justice as advertised.

Simplistic.

A Republican Congress would have gone along with a Romney AWB or a Romney amnesty, same with McCain. And we would never have gotten Trump. The Bush sycophants during the Bush years, in many cases were just as moronic as Obamabots. Obama gave us the Freedom Caucus, Trump, and a conservative base willing to fight socialism, instead of pucker. Bush was a disaster to conservatism and the Republic. Glad he’s gone.

Was there ever any real news on what those letters were. They were certainly odd and their reactions were priceless.

I saw a few Q-like explanations about what they were ... I sure can’t wait until January 2019 for all of them to be hauled off to Guantanamo (sarcasm) ... I’m sure the Q-tips-lodged-in-the-brain patrol have new excuses as to why nothing had happened.

Garland is far to the left of Roberts so your idea is insane.

Never mind that there is precisely zero evidence Roberts committed an impeachable (of any) offense, which I presume is what you are driving at. Voting the wrong way, unfortunately is not a crime.

In any case, as pointed out Robbi may well or is even likely to uphold the law but doesn’t like futzing with “precedent” in the mean time so maybe some chillaxing is in order.

I’m amazed that anyone thinks it’s more likely that Roberts is somehow being blackmailed to vote with liberals SOMETIMES (even though he’s outraged them on many major rulings) than it is that he’s just a self-important twit with a cockamamie judicial philosophy.

If Clarence Thomas suddenly turned “moderate” there could be an argument for that but is Roberts Lucifer fallen from heaven? No, he’s a guy who’s conservative bonafides were in question from the start.

Bush sucks but I find this very hyperbolic.

RBG and Breyer, appointed by Clinton, have done more damage to this country that both Bush’s combined and multiplied by 300. Not to mention all the lower level judges appointed by Clinton (though a few of Bush’s have made sucky rulings, compared that to ALL of Clintons). And I haven’t even mentioned letting China steal our secrets and letting Al Queda flourish, so unless you don’t consider Bill Clinton a “modern” President, I cannot agree.

And it goes without saying (but no one on this thread is saying it so I will) that Alito (though not his first choice, Harriet Myers was) is an outstanding Justice.

There’s something to be said in favor of avoiding .... overturning decisions by 5-4. As 6-3 is better, but if they don’t have six votes:

Get one liberal to join him in a middle ground 3-3-3 breakdown .... 3 Judges for partial overturn.
Or 2-5-2. With 2 libs.

Can’t guess if Roberts will succeed in getting 1 of the libs to give up their pure leftism.
