(KGTV) - The California Supreme Court Monday upheld the conviction and death sentence for David Westerfield, the man found guilty of killing 7-year-old Danielle van Dam in 2002.
Young Danielle was reported missing from her Sabre Springs home on Feb. 2, 2002, and her disappearance led to a search that spanned all of San Diego County.
Investigators gathered enough evidence to arrest Westerfield, a neighbor of Danielle and her family, for her disappearance and death on Feb. 22.
Five days later, Danielles badly decomposed body was found along Dehesa Road in Harbison Canyon.
In August 2002, Westerfield was found guilty of first-degree murder, kidnapping and child porn possession. He was sentenced to death and is currently on death row at San Quentin State Prison in Northern California.
On Monday, the court ruled that Westerfields sentence will remain despite his legal teams request for a new trial and opposition to the states death penalty law.
Westerfield's legal team can ask that the U.S. Supreme Court review the state court's decision.

No mention of her MOTHER and FATHER who were either drunk or high (or both), in and out of their house for a screw or up at a swingers party up and down the street with their door(s) wide open...THATS what the adults were doing. Westerfield knew this and made his move.
It was the parents fault! Had they remained faithful and sober, they would have a beautiful daughter and possibly grandchildren. ....

Currently, 740 await “execution,” and all meet their demise by natural death or whenever we’re lucky, by the hands of another prisoner, but that’s really rare, given that death row inmates are housed separately and taken to shower all by themselves.
This piece of crap is STILL alive?? Figures, it is California after all..heck Polly Klaas’s killer is still breathing, and we the taxpayers are paying for his meals and big screen TV

Lindbergh’s son’s murderer was executed in under 2 years, including all appeals, from arrest to last rites. Progressives have taken us backwards in many ways.
