So the math works like this, assuming Roberts has moved to the Dark Side:
If she’s not on the Court, then a party line vote (4-4) will NOT overturn anything anything from the lower courts. That probably doesn’t help us much if it’s the 9th Circuit, but other circuits which rule in our favor will not be overturned.
If she’s replaced, then we can overturn the 9th and anything else we don’t like (and, of course, uphold what we do like).
If Roberts gives a damn about the future of his adopted kids, then Ruth’s fate doesn’t even matter. Hopefully that’s the case.
The 9th is toast after 2020
