If isn’t an emergency to shut the border, when thousands at a time are trying to invade our borders, bring in drugs, selling children, bringing their own flags, not wanting to be Americans, but to have tax dollars pay for their keep.. if this is not an emergency... the leaders in congress have lost their minds. Some years ago, when we cared for America, this would have passed both house and senate.. but the politicians who are hooked on power... it changes everything good in this country, to bad and destruction of what we have held to be the greatest country.
But those same congress persons can rationalize... can tell the lie to the people often enough... to remove the President from office. That is their emergency... the people can stuff it!
Yup he would face political challenges, but it really doesn’t matter. They already have the 9th circuit standing by to stop it. Legally he can do it and now since Ginsberg is missing court sessions he will eventually win, except maybe for that dunce Roberts.

He does not need explicit approval from Congress.

Obviously. But arguing the CIC can’t be CIC will be pretty tough.
Congress has already voted on, and approved a wall. More than once probably. Funding it is another issue, apparently.
I hope they all die in a fire at this point, however.

So if a court blocks a military order by CIC to deploy troops and build a wall, next time they can block Trump from responding to China after they blow up a couple of US carriers.
The courts intervened to stop the military from forcing workers back to work in a defense related industry. However, Reagan prevailed when he forced the air traffic controllers back to work. So there is a mixed history here.
An emergency order to build the wall does not interfere with domestic workers or the rights of individual Americans (border landowners will receive fair compensation). We do have a failure of border security, so a wall is needed. Many arguments can be made that this rises to a crisis level, and I pray that Trump will make them Tues. night.

Yes Obamacare was illegal a government forced insurance program.
The only “national emergency” the democrats have is that we are not a socialist country YET.
