The total cost to complete the wall is actually $21 Billion. Trump is only asking for $5 Billion out of the current budget.

Actually while the govt is partially shut down law suits against government get out on hold. At least when they want it to be.
This would involve DHS border patrol which is impacted by the shut down. So the suit should go no where.
The Dems already have a Hawaiian judge lined up to stop construction of any possible congressionally appropriated wall.

Dear Dems: The wall first has to be built first, so we can find out if it works. This seems a fitting thing to do as this is how you, Dems, passed & enacted the health care bill. This is all beltway theater. Dems are dug in with an energized base supporting them and top cover from the media. They won’t fold on this. POTUS is hamstrung by the Mueller Coup and doesn’t even have the full support of his own party. So we will get another few weeks of shutdown theater. Then McConnell will shove another pile of garbage spending bill on Trump’s desk and he will sign it. If he doesn’t his veto will be overridden.
I dont know the answer to your question but id wager its actually less than the official number, with the difference being pocketed by some of these politicians who miraculously become multi-millionaires once in office.

So the issue isn't the authority to protect the country and who has it, the issue is, if the writ of habeas corpus hasn't been suspended by Congress, then how far does the authority the President has go?
The premise of a lawsuit to stop the wall, which I'm sure is written and ready to file, is that failure of the Executive Branch to carry out its duties to control immigration is NOT a "national emergency" but simple incompetence, and that since Congress has passed legislation which SPECIFICALLY FORBIDS spending money on a wall, that declaring an emergency to do it is simply a ruse.
Look into Youngstown Sheet and Tube v. Sawyer. When President Truman used a national emergency to issue an executive order to send steelworkers back to work to make steel for the armed forces engaged in an actual armed conflict, the US Supreme Court in 1952 overruled him because there was an actual labor dispute underway under the terms of existing legislation, which the EO would prevent from functioning.
I'm sorry but the national emergency thing is not going to work unless it involves the dismissal and probably the arrest of Congress, which would raise a whole bunch of other issues.
