The current backlog of Asylum cases in our Immigration Courts is over 200,000, about a 1,800% increase since 2008. Total backlog of all removal cases is nearly 800,000. In 1980, nearly 40 years ago, Congress passed a law regulating how to handle refugees who enter the USA while fleeing persecution in their home country. It says the US will accept applications for asylum from any alien physically present in the USA...OR...who arrives in the US “whether or not at a designated port of arrival”.
However, the President has certain authority to control the entry of aliens to this country;
And the Congress has authority to pass laws regarding immigration and naturalization;
And the Courts have authority to examine, apparently, whether either has exceeded their authority above that which is granted by the Constitution.
And there’s our quandary, folks. The Congress will not do anything to address the problem of overwhelming immigration cases. President Trump is TRYING to do something about the problem but consistently meets the Courts claiming he is exceeding his Constitutional authority.
The 9th Circus lost when they tried to stop his ‘Travel Ban’. It’s anybody’s guess as to whether or not he’ll lose this one. Since the Democrats won the House, nothing will be done by Congress, we can be fairly sure, over the next 2 years. Meanwhile, one person’s “immigration” and “fleeing persecution” has become another person’s “invasion”...which may require a military response under the Commander-In-Chief (though the 9th Circus would probably hold that the President, in trying to defend the laws and Constitution, has exceeded his authority by trying to stop the invasion).
