Maybe, but more to the point, a lawyer who has filed a suit without authorization and incurs a liability for his client has committed malpractice and can be sued for that. On the other hand, every plaintiff has an obligation to mitigate her damages. Even if she didn’t know if was going to be filed, she knew about it after it was filed and did nothing to disavow it, I.e., by firing the lawyer and dismissing the case. So she’s on the hook. I just hope the financial hit doesn’t bring her to her knees
