Sorry Mr. Roberts but doing “equal right to those appearing before them” is not the first duty of an appeals judge. The first duty of an appeals judge is to act within the powers of that court.

The appeals court in this case did not have within its powers under the law to act against the president in an immigration case or in an act of border control.

This judge was obviously acting in a partisan fashion to block the actions of this president.
