The Deputy AG is supposed to fill in for the AG when a vacancy occurs, but that is stipulated only under DOJ protocols that are internal to the Executive Branch and therefore is not based on an act of Congress. In other words, the President of the United States is free to ignore the rules of succession that have been set up within the DOJ.

If he’s claiming it’s unlawful, he should be able to cite which statute is being violated.

Judge Nappy also thought CNN had a strong case against WH for removing Acosta's press pass. The judge is wrong. He's made a 180 since the Murdoch boys suspended him.

Interestingly, the appointment of Whitaker appears to be lawful but unconstitutional. It's a remarkable paradox here, isn't it?

People have no memories whatsoever.

A temporary appointment happens just about EVERY time the president asks a person is asked to resign. Obama, Bush, Clinton, Bush, Reagan, Carter... need I go on?

This is nothing new. The media and the Democrats are playing from the same playbook, and so they act as if they’ve seen nothing like this before.

Considering their addled minds, it’s possibly they don’t remember seeing it before.

I think the Left needs to see a physician. The dementia seems to be getting worse.

They don’t even evidence of remembering things that took place under oDrama.

Napalatano has been so wrong on so many things over the past few years that it is hard to take anything he says as fact. I don’t know what has happened to him but he is hard to listen to any more.

The deputy AG now in office, doesn’t have enough decency and character to notice when the president is dissing him and indirectly indicating that, he should resign.

And, like you said, the president can ignore the internal rules of succession and take over a department and running it as he wishes, and in this case, Whittaker will be, in a way, the errand boy for “Trump the AG”.

If the law says that the Attorney General must be a lawyer, then ok, it's illegal. But if not, then Trump can fire and appoint whomever he wants, as often as he wants.
