How does posse comitatus enter into this? Our country is being invaded at its southern border! By that reasoning, when the Japanese attacked Pearl Harbor (incidentally before declaring war) it was a violation of the posse comitatus act for the remnant of our Air Force to go after them. I should have finished reading the article instead of just reacting to that idiotic statement about posse comitatus. Bob Barr is a great American. I thought very highly of him when he was in congress, and if not for Sarah Palin I would have voted for him for President when he ran against Obama/McCain as a libertarian.
The posse comitatus act is not in the Constitution. The constitution provides for the president to use whatever means necessary to prevent an invasion. Putting the military on our borders is the president’s DUTY under the constitution.
If the posse comitatus act prevents the President from exercising his constitutional mandate, then the posse comitatus act is unconstitutional.
