8 U.S. Code § 1401 - Nationals and citizens of United States at birth:
"The following shall be nationals and citizens of the United States at birth:
(a)a person born in the United States, and subject to the jurisdiction thereof;"
It could be fixed by inserting the words "Of parents legally in the United States" right after the word "born". Easy, peasy.
It cites the 14th and that was already discussed above.
Would require 60 votes in the senate.
Of citizen parents. Not just legally here. Yours would include children of internationsl students, green card visas, tourists etc.
The law doesn’t have to be fixed to include anything. SUBJECT TO THE JURISDICTION THEREOF
Foreign Nationals, Aliens, and Diplomats are not subject to the jurisdiction thereof.
That’s the written intent provided from the writer of the 14th Amendment, in relation to that clause.
