In most cases of US law, that is correct, but not so with immigration law.

The President is empowered by statute and the Constitution, with absolute authority over ALL matters of immigration.

If he so chooses, he can temporarily suspend the granting of asylum to anyone who illegally crosses our borders.

The law is that a refugee must accept asylum in the first country offering it. MX offered it, they refused.

So the US doesn’t have to offer them asylum legally.
