SCOTUS Puts The Brakes On Kids’ Climate Lawsuit Against The Government

Supreme Court Justice John Roberts granted the Trump administration a stay Friday night in a climate lawsuit several young people leveled against the government.

The Trump administration repeatedly asked both the SCOTUS and the 9th Circuit Court of Appeals to stop the trial through a writ of mandamus, a rarely used judicial tool allowing a higher court to overrule a lower court before a verdict is made. Roberts granted mandamus after the 9th Circuit twice turned down the writ.

The 21 plaintiffs, all between the ages of 11 and 22, are arguing that federal officials violated their due process rights by allowing the fossil fuel industry to release greenhouse gas emissions, despite knowing for years that such emissions can cause climate change.

Not clear from the posted summary whether all the justices voted, or only Roberts.

It’s not shocking that such a lawsuit exists. People are filing silly lawsuits all the time. What is shocking (but maybe not surprising) is that the 9th Circuit allowed the lawsuit to go forward.

Dennis Prager is right. Raising kids to focus on their “rights” that other people owe them will make the world, and these kids, more unhappy. Dennis was raised in a religious environment and was taught growing up to focus on his responsibilities.

We need to remember that. Raise your kids to focus on their responsibilities to make the world a better place. To increase the happiness of those around them. Not to demand rights from everyone else like a spoiled baby.

What is shocking (but maybe not surprising) is that the 9th Circuit allowed the lawsuit to go forward.

It is not known as the "Ninth CIRCUS" for nothing!

It’s about time the SCOTUS cracked down on nonsense cases that federal courts hear because, “Oh, it’s so cute, their kids!”

That is, so many judges want to “teach children about the justice system”, that they agree to hear thousands of cases that have no legitimate point in the courts.

Some of the most egregious of this are school civil rights cases, heard over and over again, such as dress codes, school newspapers and censorship, and children being used by adults to protest and file lawsuits.

Were the SCOTUS to set some ground rules, such cases should become rare, instead of gumming the cogs in the system.

If federal judges want to be teachers, they should quit their jobs and become licensed teachers.

From the article: “...... court order requiring the federal government to implement an “enforceable national remedial plan” phasing out carbon emissions....” One sure way to phase out ones carbon emissions. Just sayin’. Also, now should read “The plaintiffs WERE seeeking.......”

I thought a lower court (PacNorWest) agreed to hear it, heard it, and dismissed it as being up to Congress, and not the Federal Courts?

Not surprised that the 9th Circus would waste time and money trying to push a political fraud into the spotlight.
