U.S. top court rebuffs appeal of Kavanaugh ruling nixing climate rule

WASHINGTON - The U.S. Supreme Court on Tuesday turned aside appeals of a 2017 lower court ruling by its newest justice, Brett Kavanaugh, that struck down an environmental rule imposed under former President Barack Obama regulating a potent greenhouse gas linked to climate change.

The appeals had been brought by an environmental group and companies that supported the 2015 rule that had limited hydrofluorocarbons, which are used in a variety of products including spray cans and air conditioners.

The ruling authored by Kavanaugh was made by a divided three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit, the court on which he formerly served. The 2-1 ruling threw out the rule issued by the U.S. Environmental Protection Agency during Obama’s presidency.

Kavanaugh has a long history of skepticism toward environmental regulations, especially those concerning air pollution.

“However much we might sympathize or agree with EPA’s policy objectives, EPA may act only within the boundaries of its statutory authority,” Kavanaugh wrote in the ruling.

So basically Kavanaugh said that the EPA must obey the law as written. I can see what a dangerous radical he is.

Reading the Rooters headline, it makes the impression that the Supremes, as their first meeting with new Justice Kananaugh, turned their back on him and reversed his lower court opinion.

Nothing could be further from the truth, Rooters.

Buried: "If the high court had agreed to hear the case, Kavanaugh would not have participated. The decision not to hear the case was made privately by the justices before Kavanaugh was confirmed by the Senate."

IOW, he went with what the law actually said rather than what someone might wish it said. That means congress can change the law if they want.

They’re going to appeal on the grounds that the WHOLE court should recuse itself since they’re all friends now.

There is some talk that the Kavanaugh Court may reopen the whole issue of that “lazy” Congress essentially delegating the ability to legislate to Executive Branch agencies.

Far overdue IMHO.

Actually there really wasn’t much of a legacy to erase..

Other than the fact he had melanin ad curly hair... you have Obamacare... horrible economy, and the failure of embracing the Arab Spring and refusing to take ISIS seriously...

Obama never stood tall. Historically, he will be only remembered for his skin color and not much else.

We are going to see a lot more of this kind of tripe from the media. Kavanaugh wrote over 300 opinions while on the appeals court and every time something comes before the Supreme Court that he wrote about and the Supremes either reject the appeal as in this case, or uphold his opinion, they will try to imply corruption because of Kavanaugh — and it will be done through innuendo and implication — but no fact. That’s the way the media and Dems operate.

Yes. Folks who don't follow the court and understand the appeals process will be (purposefully IMO) erroneous conclusion that the court ruled against Kavenaugh's opinion, when in fact they upheld it.
