This ALLEGED incident was a high school event, 34 years past the statute of limitations. No charges were every brought, and not one, cooperating witness.

This is a background investigation - sadly anything goes. I have been subject to several background investigations for security clearance purposes - and they look into anything and everything. They go way beyond just talking to references you provide - and I’ve had a disgruntled neighbor cause no end of grief by making things up. Neighbor told investigator the County Child Services had investigated us - and even though Child Services explained they didn’t know who we were, had never been here, etc..., we had to write up a laundry list of events with this neighbor to get things cleared up so they could understand the nutcase he was (big liberal - surprise, surprise).
Yes - they will look into things that are not federal crimes. Anything that could impact “character” or potentially be used by someone for blackmail.
Apparently he wasn’t listening to a word of the hearing. Even if there were no witnesses at all, CBF clearly contradicted her own testimony. Mitchell was specific enough to cite the exact interviews with various media outlets that proved she contradicted her own testimony. CBF was proven a liar in terms so simple even a Flake could understand them. Nothing left to investigate other than those providing false information to the US Senate. And those conspiring against a sitting federal judge.
