One strongly suspects that McCaskill's decision to introduce the legislation right now (about which she can rest comfortably, knowing it will go nowhere in our paralytic Congress) is linked with her struggle to retain her seat, which is up for grabs in the surprisingly tight November election in what has become an increasingly conservative state. [LOL! Is there an election or something? Maybe Ted Cruz will co-sponsor it?]

I don’t care who proposes it, I 100% agree and Congress should seize the opportunity to make eVerify mandatory for all future AND all current workers, regardless of part-time or full-time, temporary or permanent, direct or contract. This is the single best way to root out illegal aliens in the workplace. Put teeth in the law, 10 year, $100,000 fine for hiring someone without checking or hiring when reasonably clear they are illegal.

Your penalties are too harsh, methinks. Because government can make mistakes, but you get blamed. How about 100 hours community service and a $1,000 fine?

Has to be a felony. Besides, conviction means the evidence was clear that they knowingly did not use eVerify or that they had reason to know the person was illegal. Okay, if Mueller is prosecuting, he’ll stretch it but, personally, who cares. I want the penalty to be harsh to put the fear of God into employers to not take a chance.

It shouldn't be "surprising". McCaskill has only maintained her seat by dumb luck. She's pretty close to being dead meat.

Not too harsh - he stipulated that they be penalized for not checking - not for getting bad results from the government system...

Nice Area - my home town is about 10 min. South of Springfield. We had intended to retire back to that area, but the kids and grand kids are all tied to our current area-South of St. Louis, so we are staying put.

The State legislature is Republican by a wide margin. Good Farming Country too. That part of the state was “Reagan” territory when I was growing up.

Awesome! Thanks so much. My kids n grandkids know where to find me and they dont depend on me day to day.
I was worried about living sooo far North without family values. Good to know we are ok in Springfield. I appreciate the help.. my position is being eliminated here, so its go.. or live out of the car, again.

You are both looking at this from the wrong direction. The criminal act is the failure to use eVerify when hiring an employee regardless of intent. If the employer uses eVerify, then it is immune from prosecution (and civil liability) -- regardless of government error -- unless the employer knew or had reason to know, beyond a reasonable doubt, that the employee is illegal. In other words, government error is irrelevant. Also, irrelevant is intent to violate the eVerify requirement. By analogy, a person is guilty of statutory rape if the victim is underage no matter how old she looks or how many fake IDs she shows him. The crime is the act itself, not the intent. Same with the failure to use eVerify.

With that said, the penalty should be a felony punishable by no less than five years in prison and a $100,000 fine. The concern I have is who goes to prison in a corporate environment.

$5,000 Fine per day per illegal worker and a mandatory 2 year prison sentence for the first offense. Double it for the second.

Seriously, how do you enforce that law? This country has millions of workers.

I've hired hundreds, of people, as long as they have the correct paperwork, documents, I have neither the time or inclination to hunt down potential illegals.

Make it real: hiring illegals should automatically pierce the corporate veil. Liability should fall on the shareholders, while Corporate CEOs and CFOs should face prison time. Take everything and salt their fields.

These business managers/owners have been committing fraud on a ongoing basis. The have destroyied economic opportunity of generations for personal gain.

The risk needs to far exceed any perceived benefits. Fines should be $1000 per violation, per person, per day; with a $5000 minimum, per incident. Mandatory prison sentences should be required for violations exceeding a certain scope or period.

Wow, I had no idea I was that powerful or influential...20 million all by myself. That's really impressive.

In case you missed my point, I never said it wasn't a problem, just fining businesses 10 year, $100,000 fine was a bad idea, that is unworkable and unfair to business owners who try and follow the law.
