Alan Dershowitz: Michael Cohen ‘Pleading Guilty to a Crime that Doesn’t Exist

Harvard Law School Professor Emeritus Alan Dershowitz said Michael Cohen, President Donald Trump’s former attorney, is “pleading guilty to a crime that doesn’t exist” to further Democrats’ plans to impeach the president. He offered his analysis during a Wednesday interview with Breitbart Senior Editors-at-Large Rebecca Mansour and Joel Pollak on SiriusXM’s Breitbart News Tonight. “I don’t think there’s an impeachable offense,” said Dershowitz. “I believe you need to have a specific crime — treason, bribery, or other high crimes and misdemeanors — and none of the things that [Michael] Cohen pleaded guilty to would rise to that level or even come close to it. What Cohen pleaded guilty to may not even be a crime, the part about the election campaign laws.”

Just whose interests was Davis looking out for, anyway?

I think Lanny Davis is focused on three things ... maybe four if we really stretch things:

1) Get on TV as often as possible and attack Trump
2) Get information from Cohen that can be used to benefit the Clinton Foundation later
3) Squeeze as much money as possible out of a GoFundMe site

4) Maybe help Cohen in Court, if it's not too much trouble. And if Hillary says it's OK.

Before Bill Clinton ran for president, he was partners with the McDougals in Whitewater Development. By the time his election came around, Whitewater was hopelessly in debt. The McDougals bought out the Clinton’s interest in the investment for a dollar (or something like that). Now, this buy out was tantamount to a forgiveness of debt. As anyone familiar with tax law, forgiveness of debt constitutes income. The Clintons, being the Clintons, never paid income tax on this. When it was brought to their attention, they quietly paid the tax, and well, nothing else happened to them. The McDougals, as far as I know, were never charged with an illegal campaign contribution in the matter. No raids of the lawyers offices in the early morning hours. I know that Ken Starr investigated Whitewater, but this aspect was never addressed. (My recollection may be wrong here, and I appeal to Freepers to correct me if I am indeed wrong)

Why is Sessions (therefore Trumps) DOJ charging Cohn with non crimes? Why didn’t the judge step in to point this out and set everyone straight? SWAMP! Davis took the DOJ deal that is collusion!

I think this is a setup by Mueller to try and access the tax records of DJT, shopping the guilty plea to a liberal judge for the sake of discovery in proving where the hush funds originated from. Something doesn’t smell right in this whole fiasco...

Did Cohen set up Lanny Davis? Cohen got non-cooperation plea deal for real crimes and pleaded guilty to non-crimes. There is a flimflam afoot but I’m not sure who was the winner.

“If you plead guilty to two offenses that are not crimes, I can get them to completely drop 10 offenses you’re guilty of that are crimes and that would put you in jail for about 30 years. Totally up to you. Whatta ya say?”

The flim flam is in the media messaging and the opportunity to use it as a sound bite in an impeachment proceeding. i.e.:

“Trump’s attorney pled guilty to making illegal campaign contributions in order to silence a potential witness against him. This was done at Trump’s instigation and with his complete approval.”

Congress can define High Crimes and Misdemeanors any way they damn well please...as long as they have the votes for it.

A President can be impeached and removed for farting in church. It does not require the commission of a crime under the US Code.

On this point Dershowitz is wrong.

Davis is a political operative disguised as a lawyer solely for the purpose to drive a political narrative against Trump.

Somebody needs to look into his financial situation and who is really paying him. This is a Clinton attack from the inside out.

So Lanny Davis is his lawyer, and he counsels his client to plead guilty to something that isn’t even a crime. Isn’t this the very definition of malpractice? Just whose interests was Davis looking out for, anyway?

Yes, that’s an ethical violation by the attorney, but, the judge is also required to conduct a providence plea inquiry in court directly of the defendant to make sure the defendant understands the charges, and, in fact committed each and every element of the charged offense(s). Since the campaign finance ‘violations’ were not crimes, pleas to those charges should never have been accepted by the court.
