Does a mistrial help or hurt the prosecution?

If the prosecution believes that the judge's remarks have prejudiced the jury against them, then a mistrial would help them. New judge, new jury, fresh start. On the down side, the defense has seen the prosecutions case and would have more time to prepare. It all depends whether they think the judge's bias has caused more damage than a new trial would cause. At the end of the day, it's mainly a paper case. They have the tax records. They have the bank loans. They have the fraud documented. The defense can't change that.

But was there “intent” to commit a crime...Hillary destroyed physical evidence under subpoena, but they just couldn’t find the intent to commit a crime.

On Thursday, prosecutors questioned a loan officer for Citizen's Bank of New York, asking about Manafort's 2016 loan application that the bank rejected. U.S. District Judge T.S. Ellis III interjected: "You might want to spend time on a loan that was granted."

"reliance" is a key element of civil and criminal fraud. Furthermore criminal fraud requires demonstration of criminal intent, e.g. did he intend to take the money and run rather than pay it back per the terms of the loan.

We need not go there, however because the bank rejected the application and therefore did not rely on it. Whatever your view of Manafort's effort, he took nothing from the bank.

Signing a loan application knowing that the information is false? Signing tax forms knowing you made false statements? Both show intent to defraud.

Perhaps it has to do with the lawyer the judge appointed to redact Mueller’s evidence. Maybe he saw something he wasn’t supposed to see and told the judge.

I've been thinking the same thing.

Perhaps someone on the prosecution team has realized that to a jury, a jury no doubt made up of people well versed in accounting, Manafort may be looking more like the victim of manipulated accounting than like someone who was manipulating the money.

If you layer in Rudy’s comments that the entire Mueller Mole Hill is about to dramatically implode into a black sink hole, maybe the judge was tipped off to stall this sham trial while the underlying dung heap fails to act as a solid foundation. And, yes, I love mixed metaphors.

You are correct. But there is a good reason not to spend time on the Citizen’s Bank loan: It is not referenced in the indictment. Judge Ellis didn’t say it directly, but I think he was questioning why the prosecution is spending court time presenting evidence about a crime that is not in the indictment.

At the prosecution’s request, a Grand Jury indicted Manafort for loan fraud involving two specific loans that were consummated/funded. The prosecution claims to have evidence that Manafort made false representations to get the loans approved and spent the loan funds other than as agreed. Telling them to stick to evidence that relates to the case on trial seems reasonable.

Manafort is dealing with EVIL evil people who have the back of a jury who could very well be compromised by the mediapukes almost two year Russian campaign against trump with their constant vitriol and hatred they spew every freakin day! I believe the jury has been brainwashed to believe Trump is on trial here via Manafort! So yes I believe he will be sentenced to prison out of sheer hatred for the president!
