Federal judge orders Trump admin to restart DACA program

A federal judge on Friday said the government must restart the entire DACA deportation amnesty, including accepting brand new applications — but gave the administration a chance to appeal before his ruling takes effect.

The ruling by Judge John D. Bates is a major blow to President Trump, and creates even more confusion about his immigration policy.

Judge Bates said Mr. Trump and his Homeland Security Department do have the power to revoke the Obama-era DACA program, but they cut too many corners in the way they tried to do it.

Fact is, some judges are a lot smarter than others.

But under English-speaking law jurisprudence, every one of them is considered to be a lawyer.

The Swiss do it a little more shrewdly. Many of the individuals they put on the judge’s bench, according to the Swiss Civil Code, are not by training or vocation a lawyer, but a layman to whom the lawyers arguing the case must put their words into simple enough terms that the meaning is clear to even someone with no legal training. This has vastly complicated understanding of Swiss law, but the upshot is that getting entangled in the Swiss Civil Code is a nightmare for foreigners, though the Swiss seem to navigate the system well. Local custom and law prevails in the court, with references to complicated legal theories being flatly discarded by the sitting judge.

There is a Latin phrase carved into the portal of the Federal Court in Berne, “Dei proventia et hominum confusione Helvetia regitur” (The providence of God and the confusion of man rules Helvetia).

At least the Swiss are realistic about the power and limitations of the law.

A judge orders the sitting President to issue a new EO to restart a program from a prior Presidents expired EO. That should be a trick. The judge mistakes the word Executive in EO as Judicial. If he wants the program so bad why doesn’t he just write up a new law himself as JO and see if it flies.

DACA isn’t even a executive order. DACA is only Executive Action, aka policy.

Head line should have read; Judge tells Trump to restart the Illegal Program, DACA, that was implemented by an EO from an Illegal president. Trump should tell that judge to pound sand.

It’s time for a Constitutional crisis. No judge should be able to tell the President how to do his job. President Trump should defy this order until the issue is settled, probably in the Supreme Court.

Judge Bates just vetoed a law the President swore to uphold.

IOW, PDJT must think like a SJW. The law be damned. Of course, congress will be all over this clown judge who ordered PDJT to ignore the law. /s.

I chuckle when the occasional freeper insists we still have a republic.

That sounds like the judge's personal opinion and not in any applicable statute. In other words, more judicial tyranny. I guess the supremes will have to weigh in on this. What a gridlock we live in.

That is outrageous. If the law is that bad it should be declared unconstitutional, otherwise the law should be enforced as written.

It’s way past the time for Trump to lay out the reasons why all the unconstitutional orders from these political judges are not going to be followed, and let the socialists take the case to the appellate courts.

A simple, “Judge, you have no constitutional basis for your order; and based on that, it will be ignored.”
