But, will there be someone with evil intent lurking with a pry bar. Is it really THE final nail? Maybe the cities should be required to pay some sort of penalty for wasting time a resources?

Yes, if the cities had to pay Exxon/Mobile’s legal cost to defend themselves, these attempts at extortion by law firms would cease. The cities were merely cover for the motives of the greedy lawyers. But if the cities had to put some skin in the game—game over.
