I think they’re hoping Congress will impeach based on this ill-gotten evidence, even if it’s inadmissible in court.

Ignoring the attorney/client issue for a moment, the admissibility of the tape, if made by anyone, would depend on whether the state in which the taping was done allows “single party consent”.

Depends on what state you’re in. If they’re looking at an FEC violation I don’t know what is acceptable.

(a) It may be-- but is not necessarily-- privileged, so it may be inadmissible in court.

(b) Privilege issues aside, if it was recorded illegally, it is still admissible, unless the illegal recording was made by a government agent.
