He says that the list is actually 4 and that Hardiman is one of the top 4 with Barrett, Kavenaugh, and Kethledge.

Good grief. Let's see there are three tests for standing according to Scalia in Lujan v Defenders of Wildlife: 1. Particularized actual or imminent harm to the individual seeking redress or an invasion of a right or interest; that 2. a causal connection between the injury and the conduct complained of the injury has to be fairly . . . trace[able] to the challenged action of the defendant and 3. it must be likely, as opposed to merely speculative, that the injury will be redressed by a favorable decision.
The only problem is that if the President were disqualified from holding office because of constitutional ineligibility, the VP would have become President. I would argue that under those circumstances such a finding would not have redressed the injury [dripping sarcasm tag here].

I still say that McConnell should allow the Senate to go into recess. This would allow Trump to temporarily fill the vacancy with a justice to serve through the end of the following session. This would prevent the court from affirming a Ninth circus decision in the event of a 4-4 ruling.

Republicans Paul and Cruz have said Kavanaugh is another Kennedy and they probably wont support him. Collins and Murkowski voted for Barrett last year.

I seriously dont understand why we cant have another originalist. Kavanaugh, Kethledge and Hardiman are all similar to Roberts. Another Alito-like justice is an absolute minimum we should accept.

I really liked Amul Thapar. He is from Toledo, Ohio where I was born and raised until I moved to Michigan in 1989. Not sure why he is not on short list of 4 names.
He has railed against “politicians in robes” who substitute their views for the law. He holds that the three branches of governments should “stay in their lanes.”
This year in the Michigan Law Review, Thapar denounced judges who bend the law to meet their own goals and ignore the text of statutes and the Constitution to achieve an equitable outcome.
