Senate Majority Leader Mitch McConnell spiked the panic on the left by announcing efforts to replace Justice Anthony Kennedy before the midterms.
The Supreme Court Justice announced his retirement Wednesday, effective July 31, after more than three decades on the high court. His successor, chosen by President Trump, could transform the Supreme Court for years to come and the left is in a meltdown.
We will vote to confirm Justice Kennedys successor this fall, McConnell said on the Senate floor after the news broke.
Senate Judiciary Chairman Chuck Grassley echoed the expectations that the nomination process would begin soon.
For more than three decades, Justice Kennedy served with great distinction on the Supreme Court of the United States, the Iowa Republican said in the statement, according to CNN. I expect the President will soon nominate someone for the Senate to consider. I encourage the President to choose a nominee with the credentials, intellect and commitment to the rule of law necessary to serve on the Supreme Court.
Democrats are already gearing up for a fight, however, as Senate Minority Leader Chuck Schumer took to the floor and Twitter to raise the alarm.
"Americans should make it clear that they will not tolerate a nominee chosen from President Trumps pre-ordained list, selected by powerful special interests, who will reverse the progress we have made over the decades."

My @SenateGOP colleagues should follow the rule they set in 2016 not to consider a SCOTUS nominee in an election year. Sen McConnell would tell anyone who listened that the Senate had the right to advise & consent, & that was every bit as important as POTUS right to nominate.

The Senate rule change allowed Supreme Court justices to be approved by a simple majority, a fact Democrats, who only control 49 seats in the chamber, are acutely aware of.
In 2016, Senate Republicans said that the American people deserve an opportunity to speak on Supreme Court nominees.

Of course, McConnell warned Democrats back in 2013 that they would regret the so-called nuclear option. Then-Senate Majority Leader Harry Reid had started the process in order to change Senate rules and prevent the minority from filibustering nominations.

I personally think it was thoughtful of Kennedy to step down just as Democrats figured they had midterm traction w/ the border stuff.
The president nominates and the senate gives consent. If the Republicans have the necessary votes, the nominee is confirmed. If they don’t have enough votes, the nomination can be delayed or stopped completely. However, they probably have the votes. Sorry Dems, but that’s how it works.
Oh, as to the so called hypocrisy of not taking up Obama’s last nominee, that’s all about having the necessary votes, too. There’s no requirement for the senate to act within a given period of time. The Dems didn’t have enough votes—due to the expressed will of American voters at the ballot box—so the Dems couldn’t get their nominee through the process. Again, it’s as simple as that.
Conservatives, you see, tend to believe in the rule of law. We don’t make it up as we go or throw tantrums when we don’t get our way.

Not “whether”, but “to” confirm. That’s the spirit.

The Left doesn’t worry about changing the rules of the game, or how the changes they make will play out against them in the future.
That’s because they know they can always change more rules in the future, and if things get bad enough for them they know they can always just kick over the whole game board and the table and trash the whole room.

Senate needs to recess and allow a recess appointment by the POTUS. We need to be on a position of not being neutered by a 4-4 SCOTUS bench while the left stalls the process.

This can only help the Republican candidates if they act out stupidly. But they seem to have lost their political sense in the past 18 months. Now it is time to lose some Senate and House seats over their juvenile antics?

The ‘rule’ was set by Senate Judiciary Chairman Joe Biden in 1992, not by Republicans in 2016.
