That’s not the same as saying the US can turn back border jumpers. Once on US soil, they have due process and equal protection. The President can shut the legitimate entry points.

Do corpses have due process and equal protection?

Once they are on US soil they are foreign invaders and should not have due process or equal protection. They are enemies of the state and should be treated as such.

The US can repulse the invaders short of the border.

Really? So these people KNOWINGLY violate our law to get here. They plan to go under, over and through various physical barriers to get here. They get one foot over the line, and that’s WHAT, a touchdown? All the laws mean nothing? The effort that we’ve made to keep them out come to naught - now they have rights, just because they were ever so slightly more successful or ingenious in defeating our laws and our barriers than the next illegal?

BS. There has to be some court (hopefully the Supreme Court, even if after Trump replaces a Leftist) that will say that the fact that someone merely gets here is a legal technicality of no effect - that they are NOT US citizens or legal residents and, as such, they have NO RIGHTS to Due Process here.

Why do they have due process once they are on US soil? I am not clear on this.

They would have due process if they came through a port of entry... we’d have a record of their entry to prove they they are not invaders and can get them a court date if they seek asylum.

When you don’t come through the door where the Welcome Mat’s been placed, but come through the a window instead, or brok a lock to get in, you are an invader, not an asylum seeker.
And the main job of a president is to stop invasions.

“Once on US soil, they have due process and equal protection.”

They gain rights just by virtue of committing a crime?

That’s insane.

No, I reject that categorically. You gain those rights by dint of citizenship, not mere presence.

The only right they should have is the right to try and outrun the bullets fired at them by border guards.

Due process, in this case, is being deported by a duly enacted border enforcement agency.

Today’s SCOTUS decision clearly delineating between citizen/residents and those seeking to enter illegaly may just render the due process argument moot.

it is a damn good thing that the Germans couldn't invade America because then we would have needed a judge's permission before shooting them.

An illegal alien caught in the act of illegally entering the US should be summarily sent back directly. I also think that the first greeting than an illegal alien should get when they are jumping the border fence is a rubber bullet to the face.

Once on US soil, they have due process and equal protection.

Even if they do NOT pass thru a port-of-entry properly?
