I think he almost has to. I don't like it, Presidents aren't kings, they cant ignore the law and the courts when it suits them (okay, democrat presidents do it all the time but that doesn't make it right). But he has two options other than this: Wait for a bill from congress and either sign it (and you can bet it will be full of extras like amnesty for all which will lose him his base, the midterms, and his own 2020 chances) or veto it (and you can bet he will be called the Hitler that enslaves poor brown kids even though congress tried to save them). Either way he loses.

But Trump is a strategist and rather than concede inevitable defeat he found a third choice: write an EO to stop this, tell congress "no bill needed, I fixed it" and then wait for the courts to overturn it. Then he can say "look, I told you this was never my idea. The courts and congress were making me do this and now they are again!" It's his best option.
