With His New Lawsuit, McCabe is About to Learn Himself How Hard It is to Get Info From DOJ

Well, we had to expect that there’d be at least some litigation-flavored fallout over that nasty Andrew McCabe firing; ousting the guy a day before his planned retirement and thereby yanking away his health and retirement benefits was a signature Trump display of one-upsmanship.

It looks like David L. Snyder, counsel for McCabe (much like we at Law & Crime), knew that the defamation lawsuit McCabe initially threatened wasn’t really the way to go. As an alternative, he’s trying his hand at a different kind of claim. Instead of suing for some version of “Trump Shouldn’t Have Fired My Client,” Snyder has brought a Freedom of Information Act (“FOIA”) lawsuit on behalf of McCabe against the Department of Justice and the FBI; in it, Snyder alleges that the agencies have violated FOIA by failing to turn over the documents that purportedly formed the basis for McCabe’s termination. He now seeks court intervention to force the government to turn over various documents from the FBI and the Office of the Inspector General.

McCabe’s move to demand, “Really? You fired me the day before my retirement because I broke some rules? Then show me those rules!” would be pretty clever if it had any chance of actually working. The problem is, though, that by the time this lawsuit sees the light of the courtroom, the memory of McCabe’s having been untimely ripped from the FBI will be quite distant indeed.

He did NOT lose his retirement benefit. He just has to wait until he’s older...65??.

I don’t see what McCabe wants or expects besides lashing out/back.

Perhaps trying to push off/back a criminal charge?

He won’t get any useful info. DOJ is in full cover-up mode, especially rosenrat.

I’m sure McCabe have championed the “independence” of the FBI and DOJ which means rogue, unaccountable and above the law.

He was going to be able to start collecting retirement benefits without penalty when he turned 50. Now he has to wait until he is 57. But there is a very good chance this sh*tbag is going to be able to work for a short time in some other law enforcement job to enable him to retire and collect his full benefit long before he turns 57. Believe me, top Democrats and McCabe’s attorneys are working out the details right now. I am sure that there is a Hillary style book and lecture deal in the works as well. The swamp takes care of its own.

This lawsuit is a steaming pile.
As a supervisor McCabe would already have the pertinent policies and procedures he is requesting regarding his dismissal. The rules that governed his investigation are covered in the IG handbook. The dismissal would have been done after reviewing the Douglas Factors and their application by the DOJ. All this information he has and knows.

Again, a steaming pile.

Should read:
Table of Penalties and Douglas Factors.

Basically does the FBI fire people for this reason as a matter of policy and practice.

Hopefully McCabe will already be settled in at a nice jail, with a hard
core boyfriend by the time he gets these documents.

Believe me, this is not going to work out the way that you and others unfamiliar with government employee pension rules think. I have personal knowledge of similar situations. He most likely will not need go through the motions and work for 2 more days in another position; the swamp protects its own. By the time the lawyers are through bamboozling the pension board that will eventually decide this... being two days short will not mean squat. He will get his full pension and he will get the book deals and the lecture money and the whole shebang. It is ridiculous; I wish it were not this so, but it is.
