The NY State Attorney General Office filed anti-Trump harassment/anti-federal/anti-US lawsuits once every THREE DAYS that Trump has held office fighting just about every order or decision he - or any of his departments - has made since Nov 2016.
True, their first Attorney General had to step down over sexual harassment charges. But their nbr two is just as bad, just as hate-filled.
Worse, theory goes, the NY Southern District filing against Trump/Trump lawyer/supporters were filed as state case to ALLOW double jeopardy to proceed, to prevent any possible pardon from being conceived!
The proposed NY law can’t be applied to a past crime.
An ex post facto law is unconstitutional.
If D’Souza commits a state crime in the future, then he could be prosecuted.
But he can’t be prosecuted again for a crime for which he already served time.
I doubt NY wants to open a legal can of worms.

Because of dual sovereignty, both the state and the federal government could prosecute an individual for the same underlying act, if the act violated both a federal and a state law. Which is good reason enough to try to avoid federal and state laws having overlapping scopes.
But if NY currently doesn’t permit criminal prosecution of an individual who violates a NY state law who has been tried for the corresponding federal offense, and NY then changes that to permit such a double prosecution, I’d think that would only apply to future acts, or at least to individuals tried at the federal level in the future. If it applied to people previously prosecuted, how would that not violate the Constitution’s ban on ex post facto laws?
