Just as property asset forfeitures should be dependent on actual charges being filed against someone, obstruction of justice charges should be dependent on actual charges related to the alleged obstruction should be filed.

Given that the only way as a sitting president that Trump can be removed from office is impeachment and conviction by the Congress, actual criminal charges or indictment are not needed for the process. High crimes and misdemeanors are what ever the House wants them to be. That is where the Presidet's jeopardy lies.
