How that criminal referral going?
No charges and there never will be, because it wasn’t ‘exactly’ a criminal referral was it? Was it not more or less a statement that McCabe had lied under oath on 2 occasions to the FBI?
That isn’t exactly a referral, it’s more of statement of fact that a crime ‘was’ committed, but with no real recommendation that the crime be prosecuted.
In fact, the IG made a criminal referral to the US Attorney for D.C.
I expect she has been told to take no action on the referral until the next two IG reports are published. My hope is that Huber is coordinating with the US Attorney for D.C.
As I have stated on other threads, the next IG report is the one to watch.
The assessments I keep reading are that Comey and others have been given immunity around the Hillary email thing—so even juicy criminality, as I understand it, may not be punished in this round.
Who could grant immunity to Comey? Mueller can’t, he’s investigating Russia collusion. He is not involved in Hillary’s e-mail investigation.
Immunity is not a pardon. Immunity would only cover testimony or evidence provided under grant of immunity. If the government finds evidence from other sources, then they can certainly prosecute.
Now, regarding Mueller’s Russia collusion investigation...Comey most likely testified to Mueller under grant of immunity which may protect Comey from being prosecuted for leaking his classified notes. However, Comey’s book tour might be his downfall. Also, in his testimony to the Senate (I believe), Comey admitted to the leaks. His testimony would be public record.
So, bottom line is I believe Comey & DOJ/FBI personnel involved in Hillary’s e-mail investigation don’t have immunity.

I suspect this new report will take as long, if not longer.
IMHO, a special council with grand jury and indictment privileges would be a better way to go.
The crimes are there, everybody knows that. The evidence is also there.

This is generally true. However, Sessions has already said that the IG is working with high level federal prosecutors to add subpoena and grand jury powers to allow the IG to investigate.
