Supreme Court hears case on online sales tax

Online shoppers have gotten used to seeing that line on checkout screens before they click "purchase." But a case before the Supreme Court could change that.

At issue is a rule stemming from two, decades-old Supreme Court cases: If a business is shipping to a state where it doesn't have an office, warehouse or other physical presence, it doesn't have to collect the state's sales tax.

That means large retailers such as Apple, Macy's, Target and Walmart, which have brick-and-mortar stores nationwide, generally collect sales tax from customers who buy from them online. But other online sellers, from 1-800 Contacts to home goods site Wayfair, can often sidestep charging the tax.

The case now before the Supreme Court involves South Dakota, which has no income tax and relies heavily on sales tax for revenue. South Dakota's governor has said the state loses out on an estimated $50 million a year in sales tax that doesn't get collected by out-of-state sellers.

Maybe some of the vendors that use them don’t. I know we bought things recently using them and payed no state sales tx for NV. Tx for the link.

The case is South Dakota v. Wayfair, Inc. I think the oral arguments are scheduled for tomorrow. Transcripts should be available in the afternoon tomorrow at Oral Argument Transcripts. I suspect it will be an interesting read.

I’d do that, but frankly, I’m not that worried about it. They’ll get theirs, one way or another. I’m more worried about restraining them.

Have the delivery service collect the tax within their fee rate, based on merchandise valuation from the pick-up location in combination with the tax rate of delivery address.

So if they cranked up the corporate tax rate to 80% you wouldn’t care because you just pass the costs on to your customers

Yeah. I'd have to, unfortunately. But I'd still be in business and you'd be bankrupt.

Hyperbole is sometimes instructive, but I wouldn't be too worried, really. Governments have been overthrown for less.

So what happens if a small time Ebay seller living in Pennsylvania, trying to make a few extra bucks sells a used book and a jacket to a guy in Indiana?

Used merchandise. Not normally subject to sales tax.

I’m very happy for you. I actually closed my business last year to be with my son who’s been hospitalized since last September but if I start it up again I will definitely try to follow your superior business acumen.
