If the FBI didnt have a search or arrest warrant, he should have told them to FO and and walked to a restaurant to have a meal with his wife and call his attorney.
Exactly right, and why do these people even entertain talking to these clowns. If it were me I would have had three words for these clowns, lawyer, lawyer, lawyer.
They can detain you for up to 24 hours for any reason, or up to 96 if they suspect you of committing a serious crime, or 14 days if you are suspected of terrorism.
The first thing to do is ask "am I free to go?", if they say "no", then "ok, I'm under arrest, you need to read me my Miranda Rights.
If I was told/threatened with "and lying to the FBI is a crime" - I would say, "OK, in that case I am choosing to assert my 5th Amendment right against self incrimination".
That being said, they can detain someone for 24 hours, but it sounds like they were detaining Malloch regardless. If I was not being detained, or threatened, I would request they meet me at my home, or hotel. If I was being detained in such a way as appears to have occurred with Malloch, I would refuse to answer any questions without a lawyer present.

Exactly right!!

It’s a lot easier than that. Ask them if they have a search warrant or arrest warrant. If the answer is “no”; the only response is, “Then I will be on my way.” Don’t ask if you are being detained in this situation; just walk away. If they try to stop you, call 911 and report their crime. Once they know a 911 call is being recorded, they just slink away. I’ve done it.
