6. By making these two declarations President Trump has just communicated that he has the authority to NOT spend any funds he doesn’t deem necessary and will return them to the US Treasury. So, funds for Planned Parenthood? He can simply not allocate the funds.

7. Also, these declarations make some funds fungible. For instance if he determines that building a Wall on the Southern Border is a defense against Human Trafficking? He can move funds from anywhere else in the Defense Dept Allocation & simply build the Wall.

8. Congress is powerless to stop cash reallocations on an omnibus bill AND cannot stop the DOD from taking measures under a declared Emergency. 9. Despite their language in the Omnibus Bill about the Border Wall, it is trumped by the State of Emergency that Trump declared.

8) So in summary - This will go to the Courts. Congress will sue the President over the Border Wall. But here’s how it will play out - Congress and the President are co-equal branches with different functions. Congress allocates. The President spends.

9) The President has National Security as his Primary Responsibility and it’s his job to use whatever funds and declarations he needs to for that job. No Court in this Nation (except corrupt on the take Judges) would EVER rule against a President for exercising that authority.

B) You continue to build the wall while the Judiciary bloviates. Last I checked the Courts do not have an army.

Also the President can declare the Drug crisis and the illegal crisis “A Clear and Present Danger to the United States” Federalize the National Guard and p[lace them on the border to secure it.

The Congress and Judiciary have no authority to stop him as he is Commander in Chief of the U.S. Military and that authority is absolute.

7058(d) of the bill is 145 million, not all of it.

7058(d) is quoted in the post in the link below. That is the only section of the bill referenced in the letter to congress.

The process is that Congress AUTHORIZES money (which was what the Omibus did)-—”permission to spend”.

So you give your kid a $10 allowance per week. That’s what he can spend. He says I want to go to the movies.

OK, you say, here’s $5 of your allowance.

That’s the APPROPRIATION. Not all is appropriated at once. Congress watches what you are doing with that. Johnny spends the $5 on a couple of joints, you say,

Sorry, you don’t get the rest of your allowance until I’m convinced you will use it for what I intended.

Having worked on the X-30 research plane program, I saw this over and over. A failed test and Congress would slow the money until we fixed what was wrong.

So Trump “might” move a few million here or there, but when Congress sees it isn’t being used as planned, no more appropriations.

On the “planned parenthood funds”, Richard Nixon tried not spending funds on stuff he didn’t want. It was called “impounding” the funds. The courts struck this down. The only time historically impoundment is allowed is for reasons of “efficiency” (i.e., planned parenthood wasn’t killing ENOUGH babies) or “economy” (i.e., they found a way to do it cheaper, but weren’t).

Ike, JFK, and LBJ were all allowed some impoundment on these grounds-—NOT on grounds that the pres doesn’t like the program or wants to spend the money differently.
