Congress requires the FISA court to maintain a pool of lawyers friendly to civil liberties who are willing to challenge the Justice Department's applications for a spy warrant. But the court almost never uses them. . . snip
That reform, if properly implemented, could have averted the current scandal surrounding the FISA court order authorizing a wiretap of former Donald Trump campaign volunteer Carter Page but only if the Obama Administration had also properly disclosed that the Democratic National Committee and the Hillary Clinton Campaign had funded the Steele Dossier.

For those FReepers keeping up with FISAgate this is a new slant on how the system was "short circuited".
I keep my eye on FISAgate stuff as I think this is the crime that is going to hang a few folks. Easy for the average Joe to understand and understand it could happen to them. For many, the system has probably taught them the deck is stacked so revenge is not far away.

Who decides whether or not a particular lawyer is "friendly to civil liberties"?
My biggest question, though, is this: If a particular law is so draconian that those who passed it find it necessary to employ a special list of lawyers to defend people against it, is it really a law you want to leave on your books?
