Conviction in fatal school bathroom attack overturned by Delaware Supreme Court

The Delaware Supreme Court overturned conviction of a teen in the fatal beating of a classmate at a Wilmington high school in 2016.

Trinity Carr was 17 when a Family Court Judge found her guilty of criminally negligent homicide and third-degree criminal conspiracy. Amy Inita Joyner-Francis was 16 when she died April 21, 2016, after a violent encounter with Carr and two others in a restroom at Howard High School of Technology.

The state medical examiner testified that Joyner-Francis suffered sudden cardiac death brought on by a rare combination of heart and lung defects that contributed to her death.

In its ruling released Thursday, the state Supreme Court said that Carr could not have foreseen that the attack would cause Joyner-Francis to die from cardiac arrest.

"No reasonable factfinder could conclude that (Carr's) attack — which inflicted only minor physical injuries — posed a risk of death so great that (she) was grossly deviant for not recognizing it," the Supreme Court opinion reads.

During a bench trial, prosecutors accused Carr, Zion Snow and Chakiera Wright of planning the confrontation in the 20 hours before the attack. Snow was found delinquent — a term used when a juvenile is found guilty — of third-degree conspiracy.

At the center of the prosecution's case was cellphone video of the assault. The video shows Carr dragging Joyner-Francis by her long, braided hair through a handicap-accessible stall in the bathroom. Carr swings her arms and lands punches onto the head and torso of Joyner-Francis, who was on the floor clutching her purse.

The fight exacerbated a pre-existing heart condition in Joyner-Francis, leading to her death, according to testimony from the state Medical Examiner's Office.

TChris, that was my initial thought too. But reading the statute under which she was charged, it exactly fits the situation.

I thought that when a beating went down, the perpetrators would be liable for a victim’s death, no matter what could have been foreseen or not.

I had created a FILE to save articles on Delaware crime and it was entitled “Delaware Courts Suck”.

This travesty of justice proves it. Is there any leader in Delaware who is not a few sandwiches short of a lunch bucket, not politically corrupt, judicially corrupt, or just plain stupid beyond belief?

I once had to help out a teenage family member in Delaware because of something that happened as she was trying to help a cousin with a medical problem, as they were being subjected to “false imprisonment” by a couple of drunk teens.

The cops were less than useless and one might have colluded with some suspects to protect them. As I told the judge and prosecutor, “You don’t want this case to go to trial. If it does, I’ll destroy your tourism industry”.

The case did not go trial and all charges were dropped against my relative (and the other relative recovered from her asthma attack without the help of the police - only from her cousin, my daughter).

Something is wrong with one of America’s oldest states and I’ll bet the problem is spelled “liberals”.

Used to be that if your attack caused a death you were deemed responsible.

In this case they caused a death WHILE committing felony assault.

What next? Oh your honor my client did not pay attention in health class and had no IDEA that Cyndi was bad for you.

During the course of a planned assault, the perps bear responsibility for whatever happens. In this case manslaughter. The case should be resentenced.

The unanswered question seems to be, what is the maximum sentence under the remaining charge, and will the judge give her the max. It is probably less than the six months served, and either way is little punishment for murder, which I am quite sure was running through the minds of the attackers although they never suspected that death would be the result.

Could you call it the unintended consequences of BAD behavior. There are men serving life in prison for less, and those who have received the death penalty as well.

The law has always been:

YOU TAKE YOUR VICTIM, AS YOU FIND HIM

Meaning, if your victim has a serious heart condition and you

punch him on the shoulder and he dies

you are responsible FOR HIS DEATH.

That has always been true in US law.

uUntil the current era of the "creative" court system.

She should not have attacked her in the first place.
