This guy is a total bullshit artist and has now proven, once again, the Peter Principle about rising to your level of incompetence. There is more than regulation in play on this despite his collection of sycophants he calls a DOJ staff telling him otherwise. You can’t just throw out a legal definition for an item and substitute your preferred definition in order to make your regulation fit the new circumstances. It won’t take a Supreme Court law clerk to write the necessary pleadings to stand them on their head.
