How A Plea Reversal From Michael Flynn Could Uncover More Federal Corruption

Did Robert Mueller’s office withhold other evidence in Michael Flynn’s prosecution, either from the FISA court or from Flynn’s attorneys? There is reason to believe so. --------------------------------------------------------

On Friday, Judge Emmet Sullivan issued an order in United States v. Flynn that, while widely unnoticed, reveals something fascinating: A motion by Michael Flynn to withdraw his guilty plea based on government misconduct is likely in the works.

Just a week ago, and thus before Sullivan quietly directed Special Counsel Robert Mueller’s team to provide Flynn’s attorneys “any exculpatory evidence,” Washington Examiner columnist Byron York detailed the oddities of Flynn’s case. The next day, former assistant U.S. attorney and National Review contributing editor Andrew McCarthy connected more dots. Together these articles provide the backdrop necessary to understand the significance of Sullivan’s order on Friday. -----------------------

One of Sullivan’s first orders of business was to enter a standing order, on December 12, 2017, directing “the government to produce to defendant in a timely manner – including during plea negotiations – any evidence in its possession that is favorable to defendant and material either to defendant’s guilt or punishment.” Sullivan’s standing order further directed the government, if it “has identified any information which is favorable to the defendant but which the government believes not to be material,” to “submit such information to the Court for in camera review.”

Why Bombshells Are Likely Ahead

With a protective order in place, Flynn’s attorneys should start receiving the required disclosures from the special counsel’s office. There is reason to believe these will include some bombshells.------ Was other evidence withheld, either from the FISA court or from Flynn’s attorneys in negotiating a plea? Again, there is reason to believe so, given the players involved and the facts already uncovered

Read the whole thing and also keep in mind that there are reports floating around that Andrew McCabe illegally made changes to the 302 forms from Flynn's interview.

The USA needs a truth-seeking (NOT POLITICIANS) commission, composed of people OF impeccable integrity, with subpoena powers, to investigate and expose the TRUTH (WHATEVER IT MIGHT BE) about corruption and criminal activity in the Federal Government and to bring criminal charges against any law breakers.

We need it NOW!

Ever since the Ted Stevens case, this order has been SOP for Judge Sullivan.

However, what is significant in this case is that shortly after Sullivan’s order, Mueller filed a motion to delay sentencing of Flynn.

What this indicates to me is that at some point in time, Mueller became aware of the illegal use of the dossier for getting the FISC warrant.

The question is eventually going to be: At what point in time DID Mueller become aware of it? When one of his prosecutors told him shortly after they got Judge Sullivan’s order, or at some point in time before that?

If it can be proven he knew before the order, then Mueller is in a whole world of hurt.

The Brady Rule is great. Unfortunately, it relies on the honesty and integrity of the prosecutor determining was is relevant. Too many prosecutors intentionally fail to turn over evidence that is relevant and hide behind the provision by claiming exculpatory evidence wasn't relevant. The law should be changed to require the turning over of ALL EVIDENCE.

Exactly. And "alot of people" includes those who have been investigating in secret -- as nonpolitical investigations are supposed to be conducted. Keep the faith, indeed.

Too early to say what will happen, but if Flynn's plea is withdrawn, and the charge is dropped, Mueller's investigation is done.

There's no way he could survive the prosecutorial misconduct.

All Mueller had to do is drop the charges then Flynn’s attorneys won’t need the exculpatory evidence. Mueller’s “crime” would have to be tried in an individual suit.

That's not how this works. Mueller will go after Flynn's family, his friends, even his pets. He will get a conviction of something -- ANYTHING. And he will tie it to Russia/Trump.

I would caution all of us, myself included, to be careful about making assumptions about who did or did not participate in the scheme knowingly.

A prosecutor is usually at the mercy of the investigators and they assume materials provided to them are complete, thorough, fair, and impartial. I am 100% convinced that Mueller should be removed from any “collusion” or “obstruction” claims as put forth by Comey based on his relationship to Comey. Same thing for Rosenstein possibly, but I don’t know the true extent of their relationship.

We do not know where this is going, but what if Mueller and Rosenstein were not an active part of this and they were duped by the small investigative team and events unknown to them?

What if they clear the President and pass on any information they are aware of regarding wrongdoing? That is not what they are tasked to investigate after all, but their investigation is now inextricably entwined with the parallel investigation(s) and accusations of wrongdoing by some within DOJ.

I could be wrong of course and they could be as partisan as everyone else, but I don’t know that and neither does anyone else but those involved. I remember and it has been refreshed by watching the Scandalous special report on Fox regarding Ken Starr and the Lewinsky investigation how partisan the investigation became in the news and peoples pavlovian responses to defend or assume the worst about the President. In the end, there was much more going on than we knew at the time so it would NOT be fair for us to do and assume partisanship on the part of Mueller as they did with Ken Starr. This is an adversarial process so that is a natural reflex, but we don’t know what Mueller was presented about Flynn and what he was not told...... yet.

My recommendation is for everyone to wait and see where this goes..... we may end up quite surprised in the end. The evidence, given the drips of DC, appears to heavily favor he President right now.

That will not happen with Judge Sullivan. If rumors are true and they threatened to pursue Flynn’s son as part of the plea negotiations that will not not reflect well on the prosecution team - especially given the fact that the interviewer supposedly did not think Flynn lied and 302’s were changed. We should know pretty soon if Mueller requests to dismiss the case against Flynn that there are some bombshells. If this is true, I do not think Mueller will continue to pursue Flynn. After all, he (Mueller) is the one who requested the delay in sentencing so he may now be aware of something as reported last week (modified 302’s) and more. We do not know.

One thing I know for certain........ I would not want to drag a pretty sack of crap into Judge Sullivan’s courtroom. That would get ugly fast and end some careers.

The counter to this is that Mueller and Rosenstein are likely trying to protect DOJ or minimize the scandal that would splatter on them all. There have been some very serious bombshells revealed recently and if even half of them are true there is some serious butt covering happening behind the scenes.

We may end up laughing because the left and their allies in the MSM just can’t help themselves..... they are so hellbent on bringing down Trump that they may burn their own house down doing it. The Clinton’s may end up wishing they had just walked away from it all........

You're right.

My observation really is more about the office of Special Counsel than Mueller personally.

At some point, though, Mueller himself has to take some responsibility for the direction of the investigation. And it's clear with the Russian indictments that a Pro-Clinton bias pervades the Office of Special Counsel.

There are likely many more instances of foreign nationals, and perhaps organizations affiliated with a foreign government that were involved in distributing political messages during the 2016 election. One that immediately comes to mind is Christopher Steele. If he escapes indictment, while the Russian indictments stand, you can be sure that the bias is deeply entrenched.
