The Baker Act in FL is like involuntary commitment statutes everywhere - you have to meet a pretty high standard of showing a danger to others or a danger to himself before commitment will be ordered. I can imagine the kid could be suicidal after seeing what his older brother did.
Sounds to me like the biological parents were brother and sister.
One assumes there was some kind of “episode” that brought on the situation.
Because it’ll go a long way to the killer getting off with a nutso defense if the whole family is crazy. Could be Cruz’ attorney is playing this. 12 hours on a Saturday isn’t going to hurt the younger brother other than take him away from his video games. It might actually help him stay away from FB.
But, yes, in any other situation this would be the wrong move.

The Baker Act is a temporary solution- he will be out within hours if he’s not already.

Malcolm and Christine Roxburgh were neighbors of the Cruz family for many years. It was a wonderful idea. Two older people to have two little boys to look after. They were just kind people. Christine said Lynda asked her daughter, who lives up north, to take the kids when her husband died, but she refused. .....Christine said when the boy didnt want to go to school, he would bang his head against a cement wall.
Perhaps he lost it. His mother passed away in Nov and now his closest relative (brother) just committed mass murder.
Its a 12 hour evaluation. Not sure whats going to happen to him as I have a feeling the family he was staying with doesnt want him there anymore buts, I could be wrong. .
