"What if the owner wants to tear it down?"
The nation is littered with laws prohibiting owners from altering or tearing down buildings that have been designated by a government committee as "landmarks." This has always seemed to me to be an unconstitutional taking of property.
If the government wants to preserve a building, it should be forced to BUY the building at market value.
