A federal judge in New York ruled Tuesday that the government must fully restart the Obama-era DACA deportation amnesty and accept brand new applicants as well as renewals, throwing a potential wrench in the ongoing debate over the fate of “Dreamers” on Capitol Hill.
Judge Nicholas G. Garaufis said the administration does have the power to revoke DACA, but it must give a sound reason for doing so — and the Homeland Security Department’s September 2017 rationale fell far short of what is required in that regard.
He becomes the second judge to rule President Trump’s aides bungled the phaseout — but his decision is the most wide-ranging, ordering the government to not only allow those already in the program to renew their applications but also ordering the government to accept new applications.

This is the same judge that stopped the hiring by FDNY to implement racial diversity about a decade ago, some of his ruling was overturned in the appeal.

This is quickly approaching the point where the next time the CIC decides to send troops into battle some court will issue an injunction against it.
DACA violates existing immigration law. That is a sufficient reason.

They’re not ‘equal’ or ‘co-equal’. They each have enumerated powers given to them under the Constitution.
Whoever advised President Trump to appeal these unconstitutional edicts to the Supreme court should be tarred and feathered. It has just encouraged more of the same.

And plays into Trump's hands again! These rabid judges are forcing our poor President, like Br'er Rabbit into the briar patch, to explain to the American people and the Fake Media all about the main issue that made him so popular and got him elected. Free publicity!
At the same time, the idiot judges are forcing the Democrats out of any safe cover they had and obliging them to go on record once more as opposing Trump on that very issue in the year of a crucial Congressional election.
Obama issued an unconstitutional executive order to create DACA.
Subsequent presidents can undo executive orders issued by previous presidents, even the constitution executive orders, which Obama’s was not.
“Judge” Nicholas G. Garaufis is unfit and should be removed from the bench.
