Presidential Memorandum on the Delegation of Certain Functions and Authorities under Section 1238 of the National Defense Authorization Act for Fiscal Year 2018 Issued on: February 5, 2018

MEMORANDUM FOR THE SECRETARY OF STATE

THE SECRETARY OF THE TREASURY

THE SECRETARY OF DEFENSE

THE DIRECTOR OF NATIONAL INTELLIGENCE

SUBJECT: Delegation of Certain Functions and Authorities under Section 1238 of the National Defense Authorization Act for Fiscal Year 2018

By the authority vested in me as President by the Constitution and the laws of the United States of America, including section 301 of title 3, United States Code, I hereby delegate to the Secretary of Defense, in coordination with the Secretary of State, the Secretary of the Treasury, and the Director of National Intelligence, the functions and authorities vested in the President by section 1238 of the National Defense Authorization Act for Fiscal Year 2018 (Public Law 115-91).

The delegations in this memorandum shall apply to any provisions of any future public law that are the same or substantially the same as the provision referenced in this memorandum.

The Secretary of Defense is authorized and directed to publish this memorandum in the Federal Register.

It says:

TITLE III - OPERATION AND MAINTENANCE
Subtitle A - Authorization of Appropriations

Sec.301 Authorization of Appropriations
Funds are here by to be appropriated for the use of the Armed Forces and other activities and agencies of the Department of Defense for expenses, not otherwise provided for, for operations and maintenance, as specified in the funding table in section 4301.

It looks as if something like this is done almost every year. The wording might be different, but they came out while Obama was President.

Looks like a yearly rollover sorta thing, but not sure.

The House bill contained a provision (sec. 1240) that would re- quire the President to submit a report to Congress including options in response to a possible failure by the Russian Federation to comply with the New START Treaty by the deadline of February 5, 2018, as well as an assessment of whether such a failure would constitute material breach of the treaty.

The House bill contained a provision (sec. 1238) that would ex- press the sense of Congress on support for the Republic of Estonia, the Republic of Latvia, and the Republic of Lithuania, including support for their sovereignty.

I don’t understand gov or legal documents unless explained in simple layman terms. Maybe even grade school terms. So I appreciate any and all explanations.
