Experts discuss officer's use of force in 'swatting' video

Based on the approximate eight seconds of body cam video released by Wichita police, Eyewitness News asked several experts around the country if they could answer those questions.

Their perspectives didn't necessarily align.

Dr. Delores Jones-Brown is a former prosecutor and professor at John Jay College of Criminal Justice.

"It appears that all the police officers had taken cover and there are no civilians on the street," she says. "So there would not have been a necessity to fire his weapon at the time that he fired."

Jeff Noble, a former Irvine, Calif. police officer now works as a police practices consultant and expert witness in cases involving police use of force.

"Any time you're reviewing a case with a video, you have to understand that the video, first of all, is a very small component of the overall investigation," he says.

Noble says the video gives some sense of what led up to the shooting but based on the video alone, there is no way to draw a conclusion.

Dr. Maki Haberfelt, a professor of political science, agrees the video alone does not determine whether the shooting was justified, but she says it does indicate a lack of training.

I was swatted by my neighbor, with whom I was involved in a lawsuit he was losing. I started to the front door to answer the knock with a gun in my hand, then decided to check the outside camera feed. The feed showed a sheriff’s cruiser in my driveway. I left my gun on a table, which turned out to be good as the sheriff was ready to draw based on what he’d been told. The other thing that made the deputy instantly relax was I was still dressed for work in very formal clothing that didn’t fit me prowling around my neighbor’s house. But for leaving the gun on a table and still being dressed for work, I could easily have been shot.

My neighbor was running the HOA. He approved a free standing garage, even picking the design and the color. He waited until I finished it and then sued me to force me to tear it down. (Power and control freak.)

I told the deputy what had happened, proved I had not left the house by making him watch the recording of me getting home and then not leaving until he arrived. I asked the deputy to arrest my neighbor for making a false report. He said, “We don’t do that.” Since this wasn’t the first time, I handed him a copy of the law and asked again. He said, “We decide what laws to enforce.” After a similar incident another deputy suggested, “You do realize your neighbor is crazy, right? If you don’t move he will eventually kill you.” Another one told me, “I realize this is very annoying. But if you make any response, we will arrest you. Do you understand?” (The Sheriff is a Democrat. Philosophy matters.)

I moved forty miles away, incidentally, selling my house at the peak of the real estate bubble. My neighbor continued to stalk me. Eventually he gave up and stalked the new owners, who sold out in a mere six months. He’s still there and many neighbors have moved to get away from him. The power of an HOA is insane, especially when a sociopath gets control of it.

The Sheriff was and still is a Democrat. (High offices here are often multi-generational empires.) The entire law enforcement community, including the prosecutor’s office, are Democrats. There is no appeal to the law, as they decide what the law is and whether they will enforce it. I dealt with detectives and a state’s attorney. I had a lawyer who was a former prosecutor. He said, (words to the effect)”If there’s no political gain in it, they won’t take the case.”
