Excellent observation, but Rosenweasel has been de facto AG from the start when Sessions recused himself and decided to take the year off - WITH pay! He could resign, effective "when his replacement has been confirmed" to avoid Rosenweasel becoming "acting AG".
Not necessarily. Actually, if Sessions resigns, Trump doesn't need approval by the Senate to appoint someone to fill the position. Under the Vacancies Reform Act, 5 U.S.C. §§ 3345-3349d , he can appoint anyone he wants as acting Attorney General. He does not have to wait for a recess and Rosenstein won't become acting Attorney General. This person will have all the powers of the Attorney General, just not the title. So in effect, he could appoint a hardliner as AG, and he will be acting AG until he has a nominee confirmed by the Senate. There is no time limit on when he has to submit a nominee. He can take as long as he likes - meanwhile he has his hardliner in.

Rosenstein is the acting AG now on most of the Deep State matters. For example, who last night, from the DOJ, met with Ryan about the looming contempt resolution? Hint: it wasn't Sessions.

Right, I will never understands why Trump didn’t fire Rosenstien after he gave Comey’s bff Mueller a blank check and no actual limits. Roosenstein is a Rat and corrupt to the core.
