It's not a constitutional matter. Mueller wasn't appointed to operate outside the oversight of the U.S. Department of Justice. He was appointed because the people inside the DOJ with responsibility for the matter believed they had a conflict of interest that prevented them from operating objectively in their roles as U.S. attorneys.

It's really no different than a police chief removing himself from a criminal investigation when a crime victim or a suspect is a family member. Appointing an "acting chief" to oversee the matter doesn't violate anyone's constitutional rights.

Every act of the feds is a Constitutional matter. You should know that.

The issue is reasonable suspicion or probable cause. There is none. Thus no constitutional grounds for federal action per Amendment IV.

Don’t need to go any further than that, but a far as conflict of interest goes, there is reasonably a conflict of interest in Mueller.

Apparently not, since they gave Mueller a conflict of interest waiver when he was appointed, which is an an outrage, considering as you stated correctly special counsels are supposed to be free from conflicts of interest, by nature.

The irony is that "the people inside the DOJ with responsibility for the matter" appointed someone, Mueller, who has even more conflicts of interest than they had.

It's a hard thing to say, but I think that Mueller's real mission is to locate and destroy evidence of criminal wrongdoing by Democrats. The question I have is whether Sessions and Rosenstein gave Mueller this sub rosa assignment, or whether Mueller is on a frolic.
