Gay Cakes Are Not a Constitutional Right

One wonders what would have happened if the Sweet Cakes by Melissa case involved not the owners refusing to be coerced to violate their religious conscience by providing a cake not to two same-sex people celebrating their union and calling it a marriage, but rather a Muslim bakery being forced to bake a cake decorated with a cartoon picture of the prophet Muhammad covered with bacon sprinkles.

Would the bakery in that scenario be forced to pay a heavy business-killing fine for actually believing that the Founding Fathers meant freedom of religion when they enshrined it in the First Amendment? Probably not, even if the ruling was made by a liberal Oregon judge who forget that this country was founded by people fleeing religious persecution and governmental war on their religious conscience:

The Oregon Court of Appeals has ruled against Aaron and Melissa Klein, owners of the Sweet Cakes by Melissa bakery who in 2013 refused to design and bake a cake celebrating a lesbian couple's same-sex wedding [sic].

The Kleins felt that designing and making the cake to celebrate the 2013 same-sex wedding [sic] would violate their Christian faith.

On Thursday, however, the appeals court upheld the decision by the Oregon Bureau of Labor and Industries to fine the Kleins $135,000. The hefty financial penalty ultimately forced the couple to close their bakery[.] ...

"Freedom of expression for ourselves should require freedom of expression for others. Today, the Oregon Court of Appeals decided that Aaron and Melissa Klein are not entitled to the Constitution's promises of religious liberty and free speech," First Liberty CEO Kelly Shackelford stated.

Politically connected people using government as a weapon against those they disagree with was probably as far from the original intent of the Framers as you can possibly get.

Historians will note the great controversy surrounding this court decision. They may simultaneously note that at the time of the court decision that the consumption of mind altering substances in the country had reached epidemic proportions.

Ones only hope for survival in this world, is to be discriminating. Very discriminating. It is a fundamental God given right. It is what we are, and no judge can deny that right. Every decision I make is base on discrimination of some type or another. The idea that one cannot discriminate is foreign to my nature. Regardless of the reasons behind the discrimination, it is still a right fundamental to our individual freedom and liberty. That fact needs to be reestablished as one of the highest order. Without that right we have enshrined the thought police as God’s gift to mankind, the absolute antithesis to freedom and liberty.
The judge is guilty of TREASON.

Attacking Christians is what these sick minded queers and judges do for vengeance against an elderly couple. A $135,000 fine is not just a fine, this judge levied this to destroy an innocent Christian couples life. These blackrobed tyrants are simply out of control.

You are right in every regard. This is about power to force Chritian people to bend to the will of a secular blackrobed tyrant. Open homos are often allowed into these positions to drive their own personal agendas. Others are taking bribes.

This site is focusing too much on homosexuality and religion. It has nothing to do with either. People can refuse service to anyone for any reason, period. When you drag your personal beliefs into the argument, it weakens it. In fact, people are refused service all the time. For example, I would not provide service to KKK member, or a Nazi, or a murderer. Why? Because that’s my right. You may agree...or disagree.....but, that’s none of anyone’s business. Use several examples that most people would agree with to build your case, not some reference to religion. That’s when people get turned off.

Personal beliefs do have something to do with it. People live by what they believe,or at least,try to. In the religious sphere,that includes,but is not limited to,public assemblies in buildings for the purpose of worship. For the state to limit the free exercise of religion to buildings shows a very poor understanding of freedom of religion and is on the road to tyranny.

If this cake thing holds up in court, I can imagine a whole lot of examples of things that are way worse that will fall out as a result.

Can a movie production company be forced to make gay porn even if the actors object?

Can a hotel be forced to host a NAMBLA convention? If the hotel staff walks out, will they be procecuted?

As a cake shop owner, I may not actually be the one making the cakes. When I interview a baker to fill a position in my shop, do I now have to ask that person all the scenarios of cakes that he might of might not be willing to make? Do I fire him if a cake is too offensive? Do I turn him over the the authorities?

Can I tell a gay couple that none of my employees were willing to make the cake, have now been fired and I can not meet their schedule as I will have to find new bakers that are willing?

My stock response to leftists regarding this issue:
“no where have I seen *anyone* in support of a business denying service to gays, blacks, etc. Rather, it is refusal to service *activity* that every person should have the right refuse to support.

In the case of the baker refusing to create a gay-themed cake, what if the customer was NOT gay - but requested a gay-themed cake - would you support the baker’s refusal then? Why or why not? If the buyer is straight, the baker cannot be accused of discrimination based on the buyers sexual orientation - correct?”

I agree, but you’re trying to win an argument. When you bring that religion or homosexulaity in, you cloud the issue with emotion. Give your political opponent an example of someone they would not serve. That’s where the intellectual power resides. People care about themselves and their problems....not your problems. Be smart my friend.

There are so many sins Gd hates worse than whom you have sex with (among consenting adults of course). Gossip, even if true, is in the Bible akin to murder. A lot of people think that if they feel the sin is more “yucky” than their own sins, they can feel superior. Not true.

The laws of the land are as they are. If you don’t wish to rent to unmarried couples, don’t be a landlord. If you don’t wish to bake cakes for whoever wants one, don’t be a baker. Gay marriage is legal. You can’t refuse service to a protected class. Period. Plumbers can’t refuse to serve a gay couple. Just don’t be in the service biz. It’s just too tricky. You won’t be able to tell who is a murderer, a child molester, or a thief when he comes in and orders a dozen cupcakes or a new toilet. Do your job and let it go.
