Cities sue Defense Dept. over gun-check system failures

NEW YORK (AP) — Three large U.S. cities filed a federal lawsuit Tuesday against the Department of Defense, arguing that many service members who are disqualified from gun ownership weren't reported to the national background check system.

New York City, San Francisco and Philadelphia said in court papers that the military's broken system for relaying such information helped spur the massacre of 26 people inside a Texas church last month.

"This failure on behalf of the Department of Defense has led to the loss of innocent lives by putting guns in the hands of criminals and those who wish to cause immeasurable harm," New York Mayor Bill de Blasio said in a statement. "New York City is joining Philadelphia and San Francisco to stand up to the Department of Defense and demand they comply with the law and repair their drastically flawed system."

Local law enforcement officials rely on the FBI's database to conduct background checks on gun permit applications and to monitor purchases. It must be up-to-date in order to prevent people from wrongly getting guns, the cities' attorneys wrote.

The lawsuit filed in federal court in Alexandria, Virginia, seeks an injunction and judicial oversight to ensure ongoing compliance with the Defense Department's obligation to submit records.

Federal officials didn't immediately respond to a request for comment on the accusations. Military officials previously acknowledged problems with their reporting.

The Defense Department's failure to report "significant numbers" of disqualifying records to the FBI's national background check system allowed former U.S. Air Force member Devin P. Kelley to buy a rifle and shoot 26 people to death Nov. 5 in a Sutherland Springs, Texas, church, the lawsuit said. Kelley had been convicted of assaulting family members in a 2012 court martial and should not have been allowed to purchase a gun.

Well in this case running high powered rifles to drug cartels must be REALLY bad (Fast & Furious).

The BEST way for leftists to rally the American people against guns is to PROMOTE MASS SHOOTINGS. These failed background checks were WILLFUL NEGLIGENCE by Obama & Co. in an effort to trigger mass shootings..

BTW, if cities are going to sue the gubmint for allowing bad guys to shoot people up, DO CITIZENS NOW HAVE THE RIGHT TO SUE SANCTUARY CITIES FOR ALLOWING ILLEGAL ALIEN CRIMINALS TO KILL AMERICAN CITIZENS?

Can’t argue with the need for the DoD to clean up their act with regard to their service men’s and women’s disqualifying medical histories, but a lawsuit is just the RATs way of spending other people’s money and trying to put the blame on Trump for something that’s been amiss for a very long time, and for big RAT-run law firms to collect unwarranted fees.

its sicko-hilarious that dangerous cities like NY and SF spend taxpayer money like this on silly lawsuits that...if they got anywhere at all.. would only make their miserable cities even more dangerous

you can’t even ride the train in NY or SF without being very alert and READY to defend yourself... seriously so

Don't know if a unanimous verdict is required in civil cases but if they are then these Rat infested (pun absolutely intended) cities will be glad that I can't be on any of the juries.

just remember that the loopholes\cracks\negligence of the DOD and Kelly’s bad behavior prior to the shooting all happened during O’bama’s non-watch.

What galls the hell of of me is that these States seek to benefit financially for the DoD’s failure. Any money that comes from these lawsuits should be for the benefit of the survivors of these shootings - particularly spouses and children. The States have NOTHING coming to them - not even the expense of first responders. That personnel is already bought and paid for, whether they sit on their butts at the station or are out in the field on an active shooter call.

One good thing out of this mess is that more illegals should migrate to those cesspools, thereby making it easier to round ‘em up when the time comes.

In many parts of the country most of the first responders are volunteer rather than paid employees. They should share (the departments, that is) in the proceeds of such suits.

They are worried about vets while they sign into law chain migration that caused the two latest terrorist attacks. The defense department needs to counter sue the liberal cities politicians who signed the law
