(9th Circuit) Federal appeals judge announces immediate retirement ... sexual misconduct

Alex Kozinski, the powerful judge on the U.S. Court of Appeals for the 9th Circuit who was facing a judicial investigation over allegations that he subjected 15 women to inappropriate sexual behavior, announced Monday that he would retire effective immediately.

In a statement provided by his lawyer, Kozinski apologized, saying that he “had a broad sense of humor and a candid way of speaking to both male and female law clerks alike,” and that “in doing so, I may not have been mindful enough of the special challenges and pressures that women face in the workplace.”

“It grieves me to learn that I caused any of my clerks to feel uncomfortable; this was never my intent,” he said.

Kozinski, 67, said although family and friends had urged him to stay on, “at least long enough to defend myself,” he “cannot be an effective judge and simultaneously fight this battle.”

“Nor would such a battle be good for my beloved federal judiciary. And so I am making the decision to retire, effective immediately,” he said.

This is not going to affect the ideological balance on the 9th Circuit Court of Appeals. Kozinski was a hard right judge. He was on the record as supporting capital punishment, but only if done by firing squad or guillotine.

Tragic in its way. I would much rather that other judges on the 9th be replaced first. But, guess who gets to fill the vacancy!

Kozinski is, probably the most conservative, originalist and textualist on the Ninth Circuit.

The only win is that Trump will be able to replace him.

I have read a couple of his arguments. Kozinski is first rate.

Humor and liberals doesn’t mix. They have no sense of humor and no sense of proportion, not to mention every one of them sincerely believes they are a kind of secular saint. This guy can’t be very liberal.

And it sucks to work with them... small loss.

They can’t even be trusted to go get you a cup of coffee because for certain they will spit in it or worse. Get a back rub from one? No way, you’ll get knifed.

He’s pretty old and this is the best opportunity in years to leave the court with a reasonable assurance that your replacement will not be a bat-crap crazy liberal. So he’s leaving with grace and in a gentlemanly manner which doesn’t seem to fit the aggressive image his accusers would probably like to cast him.

Would be nice if he could grab a few of the other judges and pull them from their perches on the way out.
