That was what I was thinking until corrected by Publius and the facts.
If legally elected they cannot refuse to seat him.
Their only recourse would be removal which requires 2/3 vote.
They can't do that. The Supreme Court ruled in, I think the 1960s, that they can only refuse to seat someone who's ineligible to be in the U.S. Senate (age, residency, etc.)
If Moore wins, it's either an expulsion vote or he is a Senator. I doubt they have two-thirds of the Senate ready to toss someone out over unsubstantiated accusations about something from decades ago, with no charges/conviction. Sets a pretty bad precedent.

Someone needs to get the Turtle a copy of Powell v. McCormack, 395 U.S. 486 (1969). In that case, the Supreme Court ruled that a House of Congress could refuse to seat a person certified by his State to have been validly elected only if that person fails to meet the Constitutional qualification for being a member of that House.
This means if Moore is elected, the Turtle will not be able to keep him from being a Senator. Choke on that, you RINO bastard!
