Judge Rules DACA Recipients Have Due Process Rights

A federal judge in Seattle, Washington, ruled that illegal aliens receiving amnesty under President Obama’s Deferred Action for Childhood Arrivals (DACA) cannot have their status revoked without due process. Judge Ricardo S. Martinez, appointed by President George W. Bush, said illegal aliens have due process rights and that DACA cannot be canceled justification, The Washington Times reported.

“While the Court recognizes and acknowledges that DACA does not confer lawful status upon an individual, the Court also finds that the representations made to applicants for DACA cannot and do not suggest that no process is due to them, particularly in Plaintiff’s case where benefits have already been conferred,” Judge Martinez stated in his ruling.

The judge did not explain what due process procedures might be acceptable.

“What process is due, and whether Plaintiff received such process, are ultimately questions for another day. But at this stage of the proceedings the Court is satisfied that Plaintiff has raised a plausible due process claim that will not be dismissed,” Martinez explained.

Texas and nine other states announced they would sue the Trump Administration if it did not end the DACA program in June, Breitbart Texas reported. The states threatened to add DACA to an existing lawsuit that effectively ended Obama’s other amnesty program, Deferred Action for Parents of Americans (DAPA).

Fine. Give all DACA criminals the immigration court hearings they are entitled to under “due process”. Charge them the cost of those hearings. Since they are all here illegally, deport every single one of them.

So we just extend the Americans to whoever liberals deem worthy.

What Obama does illegally by executive order can not be undone legally by executive order?

Get a rope.

I’m not looking forward to the coming Civil War, but it really needs to happen sooner rather than later.

Same here. We are long overdue. The reason why the leftards dont want guns is because they know we will wipe them out.

Imagine that, judge, a lawyer herself, declares another gold mine for lawyers.

So did a judge just give rights normally reserved to citizens to non-American citizens?

They also have to renew paperwork; many have not. Many do not follow the terms, then cry when they are being deported.

The pertinent read of the 5th Amendment, “No person . . . shall be deprived of life, liberty, or property, without due process of law.”

Sorry judge, sending someone back to their home country does not deprive them of life, liberty, or property.

What is needed is an impeachment, a judicial scalp or two every year to keep judges in their Constitutional box.

No gonna’ happen without repeal of the 17th Amendment.

If someone breaks into your house, do they have due process rights to your refrigerator?
