A 53-year-old woman riding a horse down a busy Florida highway has been arrested and charged with driving drunk.
Polk County Sheriffs officials said in a news release that someone called 911 about a woman, who appeared confused and possibly in danger. When deputies arrived they found Donna Byrne riding her horse in the road.
Officers did a sobriety test and said she gave breath samples that registered blood alcohol level of .161 much higher than Floridas legal limit of .08.

No DUI in our state. Not a “motor vehicle.” Other citations ARE available, but no DUI.

Can’t wait to see the judge rule on this one, let alone how the required immobilization will be implemented if the judge is an idiot and finds guilt.

You’d think it would be public drunkenness, or disorderly conduct, or public endangerment.
Not to mention animal abuse. The well-being of the horse would matter more to me than that of the idiot on it.
Eventually the DUI got dropped, but he still had to pay the ticket for running the red light. On a bicycle.

Precisely, bears repeating. Public intox, causing a nuisance on public road etc etc. DWI = OMVWI.
Unless a horse can be defined as a motor vehicle, I don't think this charge will stand. But ... and this is a very large but ... there's a reason why any attempt by a non-lawyer to interpret laws on the basis of logic, common sense, or simple morality is generally doomed to failure.

Impeding traffic. Bicyclists can also be charged with DUI/DWI.
True, but that additional statute is written and classifies a bicycle as “human powered” of which technically a horse is not.
