Opinion: The 25th Amendment Proves Why Trump's Mental Health Matters

The 25th Amendment is the ultimate constitutional "check" — a corrective mechanism for an American president who is physically or psychologically unable to lead. Most important, it grants legal authority to those closest to power — first, the vice president and Cabinet members, then members of Congress — to stage an intervention. At the very least, these individuals are authorized to call a temporary timeout if the president is judged unfit to govern.

Is America today in need of such an unprecedented intervention?

Pundits and politicians alike have called for the amendment’s implementation over the past few months. But it is both practically and philosophically a tool of last resort.

As an expert in presidential ethics and a clinical psychologist with an expertise in treating patients with personality disorders, respectively, the authors of this editorial have no relationship to President Donald Trump.

At this juncture, waiting for unfitness to manifest beyond the types of observable and highly predictive behavior patterns studied by psychiatrists and psychologists is, we believe, naïve. Though remote, we cannot rule out the possibility that a president in a downward mental health spiral could destroy important global partnerships, alter centuries-old alliances and leave the United States vulnerable to terror attacks or war.

The 25th Amendment was created so that those closest to the president could respond in the event of a physical or psychological crisis. In turn, it is the duty of these individuals to be vigilant and act in the best interests of both the president and the citizens who rely on him — because responding to danger from within is as crucial to this nation’s survival as responding to danger from without.

The 25th amendment stuff is pretty comical. The reason is simple: Just as nobody is physically perfect, nobody is mentally perfect.

For it to apply, you have to show some pretty serious symptoms. Showing up to staff meetings in your wife’s underwear may apply. Talking like a normal human being, rather than a politician, is not a sign of mental instability, though.

The 25th Amendment is not designed to remove a president against his will. That’s why its procedures are much more difficult to follow through than those for impeachment.

Likely those promoting this haven’t read the 25th all the way through, or are just hoping for a coup with the 25th as some cover to fool the stupid.

Serving as a Presidential ethics attorney does not make you an expert in "presidential ethics". In the statement quoted above, they show the emptiness of their whole article: They do not know President Trump. But it does let slip their agenda: Get rid of Trump!

The 25th Amendment is designed to deal with a situation where a President is either in a coma, or insane or otherwise can’t discharge the duties of his office.

Its not for removing a President whose personality or politics don’t suit you. That’s what we have elections for. Trump haters hate Trump.

But the 25th Amendment isn’t a remedy for their hate of him.
